GENERAL TERMS

  1. Whilst a high professional standard of leading, care and safety, is ensured, clients must be aware that participation in mountaineering activities involves an acceptance of risk and of responsibility for one’s own actions.

  2. Mountaineering, even when undertaken with guides and leaders is an adventure pursuit with high levels of uncertainty and potential risk. No specific element of an advertised service can be guaranteed with certainty in these environments

  3. When engaging the services of Over The Scottish Hill, you are hiring a leader for their expertise, not for the guaranteed outcome with respect to a specific objective, route or summit. The leader will do their utmost to ensure success with regard to those objectives, however, this cannot be guaranteed as safety is always the overriding priority. If it is clear, from the outset, that the advertised or primary objective is not feasible on the grounds of safety, then an alternative objective will be offered for the same date.

  4. Advertised walks are open to anyone aged 18 or over. Walks are available for both beginners and experienced walkers and are advertised as such.

  5. The right is reserved to exclude any member from a participation participation on a planned mountain activity if he or she might endanger the success or safety of the party through lack of fitness, ill-health, dangerous technique or if they are believed to be under the influence of drugs or alcohol. No refunds will made made to members so excluded.

  6. Any member of a walking event who acts in contravention of the decisions or advice of the leader or else undertakes independent mountaineering activities during the event period, will forfeit all professional protection and duty of care from the leader.

  7. All members must accept that Over The Scottish Hill is not under any liability whatsoever in respect of loss or damage to personal property not caused by the negligence or default of Over The Scottish Hill whilst attending a walk/course

  8. The information on Over The Scottish Hill website is for guidance. Every effort is made to ensure that it is correct but responsibility for inaccuracies or subsequent alterations to itineraries which are beyond reasonable control. cannot be accepted either before or during any scheduled trip

BOOKING FEES

  1. Bookings are only confirmed once a deposit (50%) of the course fee has been paid and the completed booking form and health decleration has been returned.

  2. The balance of the booking fee is required 28 days prior to the commencement date of the walk/course. If fees are not received by then, Over The Scottish Hill is under no obligation to hold your reservation.

  3. If a booking is made within 28 days prior to commencement, the whole fee must be submitted upon booking.

PAYMENT METHODS

  1. UK Bank Transfer. Please clearly state your name and walk/course in the payee reference field

  2. Bank details will be provided on the invoice upon receipt of your booking form

CANCELLATION

  1. Deposits will be fully refunded if the booking is cancelled more that 28 days prior to the walk/course

  2. In the event of cancellation within 28 days of the walk/course, no refund will be made

  3. Should you need to reschedule, this will be possible, subject to availability, up to 28 days before commencement. Thereafter, the above cancellation terms apply

  4. It is strongly recommended that you take out appropriate cancellation insurance.

CANCELLATION BY OVER THE SCOTTISH HILL

  1. Whilst every attempt will be made to ensure that advertised walks run as scheduled, the company will notify the client of cancellation as soon as is practicable where it believes, on reasonable grounds, that cancellation is necessary.

  2. In the event of cancellation by the company, customers will be offered the choice of the following options:

    Full Refund

    Another booking on a different date at the same price

  3. In the event of a forecasted occurrence of extreme weather that prevents the running of a walk/course, appropriate alternatives will be suggested. These will be discussed with the client in detail with as much notice as possible. If clients choose not to accept the alternative options offered, this will be viewed as a cancellation and no refund will be given

  4. If weather conditions are too poor to allow the walk or any other alternatives, clients will be offered an alternative booking on a different date or a full refund

  5. If it becomes necessary to cancel the event during the activity for reasons of safety, no refund will be issued.

  6. Please note that no associated costs such as accommodation or transport can be refunded

    MEDICAL DECLARATION

    You will be required to complete and return a medical declaration form before undertaking an activity with me. This will declare that you are physically fit to take part in the activity that you have booked and detail any medical conditions, medications or injuries which might affect you. I strongly recommend that you consult you GP or other appropriate medical professional if you have any doubts regarding whether a given condition will affect your ability to participate safely.

    DOGS

    If you choose to bring your dog you will be responsible for its behaviour at all times and you must:

    1. Keep dogs on leads

    2. Ensure that you bring appropriate provisions to care for your dog, including water, snacks and poo bags

    3. Ensure you have suitable insurance cover for your dog, including public liability insurance

    4. Remain respectful to other walkers, landowners and the general public

    Sheep worrying (where the dog chases, injures or kills livestock) is a criminal offence and the person responsible for the dog, shall be guilty of the offence.
